Data Protection
Learner data gathered by the Data Service is collected by the Chief Executive of Skills Funding and the Young People’s Learning Agency for England. The data is collected as required under the contractual funding arrangements of providers of learning.
The data collected from learners is processed by the Data Service, on behalf of the above organisations explained in the Privacy Notice issued by providers to each learner.
The data is primarily used to by the Chief Executive of Skills Funding and Young People’s Learning Agency for England to perform statutory functions, as described in the Apprenticeships, Skills, Children and Learning Act 2009.
Data is also shared with other bodies, as informed to learners, for the purposes of those organisations fulfilling their own statutory purposes. Such sharing is undertaken using a standard data sharing agreement for specified legitimate and restricted purposes.
Where the Data Service shares data with a third party who undertakes work for the Data Service, the Data Service requires that the sharing is undertaken under contract and is subject to a data sharing agreement, specifying the secure management of the data.
The security of Data Service systems which store the data is regularly and independently reviewed. As a further measure of assurance, the systems are also subjected to Privacy Impact Assessment and Data protection Compliance check reviews as introduced by the Information Commissioner's Office.
