Skills Funding Agency overview

The responsibilities of the Skills Funding Agency are defined in the Apprenticeships, Skills, Children and Learning Act 2009.

Data is collected from individuals and organisations, including learners, education providers and employers from across England. The Skills Funding Agency uses this data for a variety of purposes to fulfil its statutory obligations, including funding, securing the provision of education and training, the provision of services and assistance, undertaking research, and the provision of information and advice.

Under section 82 of the Apprenticeships, Skills, Children and Learning Act 2009, the Chief Executive of Skills Funding may be directed to arrange for apprenticeship functions. This Data Sharing Agreement also provides an agreed framework for the provision of information from the Skills Funding Agency to third parties in relation to apprenticeships.

Sharing data with third parties

Whenever personal data is shared with a third party, the Skills Funding Agency will always require a Data Sharing Agreement to be entered into by the data sharing partner (third party) to ensure that the purposes for which the personal data are shared are clearly understood and agreed, the personal data is properly shared, used, retained and destroyed, and all parties acknowledge their responsibilities in relation to these activities.

Under section 122 of the Apprenticeships, Skills, Children and Learning Act 2009 the Skills Funding Agency is permitted to share information for education and training purposes with other parties specified in that section for the purposes of enabling or facilitating the exercise of any relevant function as described under that section 122(5) of the Apprenticeships, Skills, Children and Learning Act 2009.

Where a third party is seeking data from the Skills Funding Agency in order to fulfil a function conferred upon it, the third party will be required in this agreement to:

· Describe the data requested

· Define the basis on which the data will be processed as set out in Schedule 2 and, in the case of sensitive personal data, Schedule 3 of the Data Protection Act 1998.

· State the statutory instrument and relevant section which confers a legal duty requiring any proposed processing of the data by the Local Authority

· Read and confirm their understanding and agree to be bound by its conditions by signing this agreement before the YPLA will share data.

Other third parties providing services to and processing the data on behalf of a party requesting the data will also be required to read and confirm their understanding and agree to be bound by its conditions by signing this agreement before the Skills Funding Agency will share the data.

The Skills Funding Agency does not provide personal data (including sensitive personal data) as a matter of routine, and requests for data must be fully justified.
